Public Hearing Notice

Residents of the Town of Newbury and other interested persons, please note that on Wednesday, April 3, 2013 at 7:30 PM at the Newbury Town Hall, 25 High Road, Newbury, MA, the Newbury Planning Board will hold a public hearing to consider proposed changes to the Code of the Town of Newbury, Chapter 97, Zoning, as follows:

  • Amendments to certain uses listed in § 97-3.M., Table of Use Regulations, to:  delete redundant uses; clarify use descriptions; revise the level of permitting required for certain uses; improve the organization of the table; and better reflect the purpose of each of the existing use districts.
  • Insertion of a new § 97-5.F. in Article V, Special Permits, to add provisions for permitting and regulation of Ground-Mounted Solar Photovoltaic Installations.  Amendments related to these provisions will also include an addition to § 97-9.A. Site Plan Review, para. (2), Applicability.
  • Boundary changes to three Use Districts: (1) the Business & Light Industrial District; (2) the Byfield Village Business District; and (3) the area of Commercial Highway District on Central Street at Pearson Plaza, to include entire parcels (rather than portions of parcels) at the outer boundaries of each of these districts, and to revise the boundaries to be consistent with existing development patterns and/or the purpose of each district. These amendments will include revisions and additions to § 97-2.B.(2) Written Description of Use Districts and to the Town of Newbury Zoning Map referenced in § 97-2.B.(1).
  • Amendments to § 97-10.D., Accessory Apartments, to revise the lot size requirements for accessory apartments in detached structures, to clarify square footage requirements, and to provide allowance for minor deviations from the requirements.
The text and maps of these proposed amendments are on file with the Town Clerk and in the Planning Department, 25 High Road, Newbury, MA, and may be inspected there during normal business hours.  They are also attached hereto for your convenience.  The attachments are categorized by name & description as follows:
